General Terms and Conditions ( GTC ) for the sale of gemstones by LieGems
1. Scope
These General Terms and Conditions ( GTC ) apply to all persons who purchase a product from LieGems. By purchasing a product, buyers agree to LieGems' GTC . These GTC apply to all orders placed on the LieGems website or other sales platforms.
2. Conclusion of contract
The contract between the buyer and LieGems is concluded as soon as an order is placed by the buyer and confirmed by LieGems. This can be done either by a written order (e.g., by email) or a verbal order (e.g., by telephone). Confirmation occurs when the purchase order is accepted.
3. Prices and payment
The prices for the products offered are listed on the respective LieGems sales platform. By ordering the gemstone, the buyer declares acceptance of the stated purchase price. Payment is made exclusively via the payment methods listed on the LieGems website. The product will only be shipped after full payment has been received.
Additional costs such as shipping costs, customs duties, or similar fees may apply and will be stated on the LieGems website or the respective sales platform. If no additional costs are stated, the buyer is responsible for all other applicable fees (e.g., customs duties, shipping costs). Upon request and with the agreement of both parties (buyer and seller), the fee split can be adjusted.
4. Delivery and shipping
Products will be delivered within 5 business days after receipt of full payment. Shipping is by registered mail. Upon request, insured shipping can also be arranged, however, this may incur additional costs for the buyer. LieGems assumes no liability for shipping times and is not responsible for delays caused by the shipping service provider.
5. Right of withdrawal
LieGems guarantees the authenticity of its products. Should a buyer discover upon receipt that the gemstone does not match the description or image, this must be verified within 14 calendar days with a certificate from a recognized laboratory. In this case, the purchase price will be fully refunded upon return of the product. However, any additional fees such as customs or shipping costs are the responsibility of the buyer.
6. Liability and warranty
LieGems is not liable for loss or damage to products during shipping. Should a buyer discover any defects in the product, they must be reported prior to purchase. If, after receiving the product, it is discovered that the product differs slightly in color or appearance from the image on the sales platform, LieGems assumes no liability. Due to varying lighting conditions and the characteristics of cameras (unlike the human eye), gemstones may vary in appearance.
If there are actual differences between the delivered product and the product description (e.g. weight, different stone type, etc.), the purchase contract will be canceled and the buyer will receive a full refund.
7. Data protection
LieGems is committed to treating all customer data confidentially. All personal information provided by the buyer will be used only as part of the purchase process and will not be shared with third parties. The data is processed internally according to the need-to-know principle and is not accessible to unauthorized third parties. All measures to protect customer data comply with applicable data protection laws.
8. Dispute resolution and applicable law
All disputes arising in connection with the contract or the General Terms and Conditions between LieGems and the buyer are subject to the laws of the Principality of Liechtenstein. The courts of Liechtenstein shall have exclusive jurisdiction to resolve disputes, unless mandatory international provisions apply.
In the event of a dispute, the parties will initially endeavor to reach an amicable settlement. Should this not be possible, the buyer may, at LieGems' request, participate in an out-of-court dispute resolution procedure. It is also possible to resort to arbitration bodies or mediation, which are recognized by the Liechtenstein legal system.
